1. IDENTIFICACIÓN.

Las presentes condiciones generales de uso (en adelante CGU), regulan el acceso y el uso de la Web bajo el dominio https://casascostablanca.nl/ (en adelante Web), titularidad de “CASAS COSTA BLANCA REAL ESTATE, S.L.”, en adelante https://casascostablanca.nl/, y provisto de CIF núm. B42542738 con domicilio en CAMI DEL REI, 13 B, 03725 TEULADA (ALICANTE), inscrito en el Registro Mercantil Sociedad inscrita en el Registro Mercantil de Alicante, tomo 4086 , folio 59, secc. 8, hoja A-157868, teléfono núm. 634366548 y email [email protected], demás datos identificativos constan en el Aviso Legal, puesto a disposición de la Persona Usuaria que navega o interactúa a través de la Web.

Ante cualquier duda o consulta relacionada con la utilización y acceso en la Web o alguna cláusula de las presentes Condiciones Generales de Uso, puede contactar con nosotros a través de los datos de contacto.

2. OBJETO.

Las presentes Condiciones Generales de Uso (en adelante, “CGU”) regulan el acceso, navegación y utilización de la Web accesible a través del dominio https://casascostablanca.nl/, así como las responsabilidades derivadas de la utilización de sus contenidos, entendiendo por éstos los textos, gráficos, dibujos, diseños, códigos, software, fotografías, música, vídeos, sonidos, bases de datos, imágenes, expresiones e informaciones, así como cualquier otra creación protegida por las leyes nacionales y los tratados internacionales sobre propiedad intelectual e industrial.

La Web tiene como finalidad principal ofrece información corporativa de https://casascostablanca.nl/, así como permitir el contacto directo con la empresa a través de formularios.

El acceso a la Web por parte de la Persona Usuaria es de carácter libre y gratuito, sin perjuicio de que la utilización de determinados servicios pueda requerir el previo registro o la contratación de servicios específicos, que estarán sujetos a sus propias condiciones de contratación o reserva.

La participación en foros, comentarios, reseñas o cualquier otro espacio interactivo de la Web deberá realizarse bajo el respeto a las presentes normas de uso, reservándose https://casascostablanca.nl/ el derecho a retirar cualquier contenido que resulte ofensivo, ilícito o contrario a estas condiciones.

La Persona Usuaria se obliga al cumplimiento de las CGU, así como a cumplir las especiales advertencias o instrucciones contenidas en la Web y a obrar siempre conforme a la ley, a las buenas costumbres y a las exigencias de la buena fe, empleando su máxima en atención teniendo en cuenta la naturaleza y contraprestación del servicio del que disfruta. • Utilizar la Web con fines ilícitos, ilegales o contrarios a lo establecido en estas CGU, a la buena fe y al orden público.
• A no introducir, almacenar o difundir en o desde la Web cualquier información o material que sea difamatorio, injurioso, obsceno, amenazador, xenófobo, pornográfico, de apología al terrorismo, incite a la violencia, a la discriminación por razón de raza, sexo, ideología, religión o que de cualquier forma atente contra la forma, el orden público, los derechos fundamentales, las libertades públicas, el honor, la intimidad o la imagen de terceros y en general la normativa vigente.
• A no introducir, almacenar o difundir mediante la Web ningún programa de ordenador, datos, virus, código, o cualquier otro instrumento o dispositivo electrónico o físico que sea susceptible de causar daños en la Web, en cualquiera de los servicios, o en cualquiera de los equipos, sistemas o redes de https://casascostablanca.nl/, de cualquier Persona Usuaria, de los Proveedores o Distribuidores de https://casascostablanca.nl/ o en general de cualquier tercero, capaz de causar cualquier tipo de alteración o impedir el normal funcionamiento de los mismos.

• A no introducir, almacenar o difundir mediante la Web cualquier contenido que infrinja las normas de propiedad intelectual, industrial o derechos de terceras personas, ni en general ningún contenido del cual no ostentara, de conformidad con la ley, el derecho a ponerlo a disposición de terceras personas.
• Reproducir, copiar, distribuir, poner a disposición o de cualquier otra forma comunicar públicamente los contenidos de la Web sin la autorización expresa del titular de los correspondientes derechos.
• Realizar actos de spam, publicidad no autorizada o envío masivo de correos electrónicos a través de los formularios de la Web.

3.2.            Acceso y Uso de los Contenidos.

4. DERECHOS DE PROPIEDAD INTELECTUAL E INDUSTRIAL.

Todos los contenidos de la Web, entendiendo por estos a título meramente enunciativo, los textos, documentos, fotografías, dibujos, gráficos, imágenes, iconos, tecnología, software, bases de datos, archivos de sonido, archivos de vídeo, diseño gráfico, código fuente y demás elementos que formen parte del mismo (en adelante, los “Contenidos”), así como las marcas, nombres comerciales u otros signos distintivos, son propiedad exclusiva de https://casascostablanca.nl/ o de terceras personas que han autorizado su uso, quedando todos ellos protegidos por la legislación en materia de propiedad intelectual e industrial.

En ningún caso se entenderá que se concede licencia alguna ni se efectúa renuncia, transmisión, cesión total o parcial de dichos derechos, ni se confiere derecho alguno, y en especial, de alteración, explotación, reproducción, distribución o comunicación pública sobre dichos Contenidos sin la previa autorización expresa y por escrito de https://casascostablanca.nl/ o de los titulares correspondientes.

La Persona Usuaria únicamente podrá acceder, visualizar y utilizar los Contenidos para su uso personal y privado, quedando prohibida su utilización con fines comerciales o profesionales, así como su modificación, copia, alteración, reproducción, adaptación o traducción, total o parcial, sin la autorización expresa de los titulares de dichos derechos.

El incumplimiento de lo dispuesto en la presente cláusula podrá dar lugar al ejercicio de las acciones judiciales que correspondan en defensa de los derechos de https://casascostablanca.nl/ y, en su caso, de los titulares legítimos de los derechos de propiedad intelectual e industrial.

Mediante estas CGU no se cede ningún derecho de propiedad intelectual o industrial sobre la Web ni sobre ninguno de sus elementos integrantes, quedando expresamente prohibidos a la Persona Usuaria la reproducción, transformación, distribución, comunicación pública, puesta a disposición, extracción, reutilización, reenvío o la utilización de cualquier naturaleza, por cualquier medio o procedimiento, de cualquiera de ellos, salvo en los casos en que esté legalmente permitido o sea autorizado por el titular de los correspondientes derechos.

5. EXCLUSIÓN DE GARANTÍAS Y RESPONSABILIDAD.

5.1.             Exclusión de Garantías y Responsabilidad por el Funcionamiento de la Web.

https://casascostablanca.nl/ no garantiza la disponibilidad y continuidad del funcionamiento de la Web ni de los servicios o Contenidos ofrecidos en el mismo, ni que el contenido existente en la Web se encuentre actualizado. En consecuencia, no será en ningún caso responsable por los daños y perjuicios de cualquier naturaleza que puedan originarse por:

• La falta de disponibilidad o accesibilidad a la Web.
• Interrupciones en el funcionamiento de la Web o fallos informáticos, averías telefónicas, desconexiones, retrasos o bloqueos causados por deficiencias o sobrecargas en las líneas de telecomunicaciones o en Internet.

https://casascostablanca.nl/ llevará a cabo, siempre que no concurran circunstancias que lo hagan imposible o de difícil ejecución y tan pronto tenga noticias de los errores, desconexiones y/o falta de actualización de los contenidos, todas aquellas labores tendentes a subsanar los errores, restablecer la comunicación y/o actualizar los referidos contenidos.

Asimismo, https://casascostablanca.nl/ no garantiza ni la fiabilidad técnica de su Web, ni el acceso a sus distintas páginas, quedando de la misma forma exonerado de toda responsabilidad por los daños y perjuicios de cualquier naturaleza que puedan originarse por esta causa.

Además, https://casascostablanca.nl/ no se hace responsable de los posibles errores o deficiencias de seguridad que pudieran producirse por la utilización por parte de la Persona Usuaria  de un navegador de una versión no actualizada o insegura en el navegador o de los daños, errores o inexactitudes que pudieran derivarse del mal funcionamiento del mismo.

A pesar de que https://casascostablanca.nl/ adopta las medidas de seguridad técnicas y organizativas adecuadas para proteger la Web, no garantiza la ausencia de virus ni de otros elementos que puedan causar alteraciones en el sistema informático (software y hardware) de la Persona Usuaria o en los documentos electrónicos y ficheros almacenados en su sistema.

En consecuencia, https://casascostablanca.nl/ no será responsable de cualesquiera daños y perjuicios que se produzcan por la presencia de virus u otros elementos dañinos.

Con el fin de disminuir el riesgo de introducción de virus en la Web, utiliza programas de detección de virus para controlar todos los Contenidos que introduce en la Web. No obstante, https://casascostablanca.nl/ no garantiza la ausencia de virus, ni de otros elementos en la Web introducidos por terceras personas ajenas a https://casascostablanca.nl/ que puedan producir alteraciones en los sistemas físicos o lógicos de la Persona Usuaria o en los documentos electrónicos y ficheros almacenados en sus sistemas. En consecuencia, https://casascostablanca.nl/ no será en ningún caso responsable de cualesquiera daños y perjuicios de toda naturaleza que pudieran derivarse de la presencia de virus u otros elementos que puedan producir alteraciones en los sistemas físicos o lógicos, documentos electrónicos o ficheros de la Persona Usuaria.

https://casascostablanca.nl/ adopta diversas medidas de protección para proteger la Web, los datos recabados y los Contenidos contra ataques informáticos de terceros. No obstante, https://casascostablanca.nl/ no garantiza que terceros no autorizados puedan tener acceso al tipo de uso o navegación de la Web que hace la Persona Usuaria o las condiciones, características y circunstancias en las cuales se efectúa. En consecuencia, https://casascostablanca.nl/ no será en ningún caso responsable de los daños y perjuicios que pudieran derivarse de dicho acceso no autorizado.

https://casascostablanca.nl/ no se hará responsable en ningún caso del uso que las personas usuaria o terceras personas que pudieran hacer de la Web o los Contenidos, ni de los daños y perjuicios que pudieran derivarse del mismo.

 5.2.           Exclusión de Garantías y de Responsabilidad por los Contenidos.

https://casascostablanca.nl/ no garantiza la fiabilidad, utilidad, veracidad, exactitud, exhaustividad y actualidad de los Contenidos. La Persona Usuaria reconoce que el uso de la Web y de los Contenidos se realiza bajo su exclusiva responsabilidad.

En particular, https://casascostablanca.nl/ no será responsable de los daños y perjuicios que se puedan derivar de:

• La falta de licitud, calidad, fiabilidad, utilidad, veracidad, exactitud, exhaustividad y/o actualidad de los Contenidos.
• La inadecuación para cualquier propósito y la defraudación de las expectativas generadas por los Contenidos.
• Las decisiones o acciones adoptadas o evitadas por la Persona Usuaria a partir de la información facilitada en la Web, ni de los daños y perjuicios sufridos con motivo de actuaciones que tengan como único fundamento la información obtenida en la misma, incluyendo sin limitación la pérdida de beneficios u oportunidades empresariales.

5.3.           Exclusión de responsabilidad por servicios prestados por terceras personas a través de la Web.

La Web puede poner a disposición de la Persona Usuaria dispositivos técnicos de enlace (tales como links, banners, botones), directorios y herramientas de búsqueda que permiten acceder a sitios web pertenecientes y/o gestionados por terceras personas.

https://casascostablanca.nl/ no ofrece ni comercializa por sí ni por medio de terceras personas los productos y/o servicios disponibles en dichos sitios enlazados, ni asume responsabilidad alguna por la información contenida en los mismos, ni por los daños que pudieran derivarse del acceso a ellos.

 5.4.           Exclusión de responsabilidad por conducta de las Persona Usuarias.

https://casascostablanca.nl/ no será responsable de los daños y perjuicios de cualquier naturaleza derivados de la utilización que las Personas Usuarias realicen de la Web, así como de los Contenidos o de los servicios que se ofrezcan en él, contraviniendo las presentes CGU o la ley.

6.  HIPERENLACES.

Aquellas personas que se propongan establecer hiperenlaces entre su página Web y la Web deberán observar y cumplir las condiciones siguientes:

• No será necesaria autorización previa cuando el Hiperenlace permita únicamente el acceso a la página de inicio de la Web, pero no podrá reproducirla de ninguna forma. 7. ACCIONES EN CASO DE INCUMPLIMIENTO.

8. NULIDAD PARCIAL.

La declaración de cualquiera de las cláusulas contenidas en estas CGU como nula, inválida o ineficaz no afectará a la validez o eficacia de las restantes, que seguirán siendo vinculantes entre las partes.

9. POLÍTICA DE PRIVACIDAD Y COOKIES:

El tratamiento de datos personales se regula en la Política de Privacidad y la instalación de coolies en la Política de Cookies, ambas disponibles en la Web.

10. NOTIFICACIONES.

A los efectos de practicar las oportunas notificaciones, https://casascostablanca.nl/ designa como domicilio de contacto el especificado en el Aviso Legal.

El correo electrónico que pueda facilitar la Persona Usuaria durante el proceso de registro en la Web, de haber algún registro, será el utilizado por https://casascostablanca.nl/ a efectos de practicar notificaciones la Persona Usuaria.

La Persona Usuaria está obligado a mantener debidamente actualizados los datos que a efectos de notificaciones se referencian en la presente cláusula.

Todas las Notificaciones que efectúe https://casascostablanca.nl/ a la Persona Usuaria se considerarán válidamente efectuadas si se han realizado empleando los datos y a través de los medios anteriormente señalados. https://casascostablanca.nl/ no se responsabiliza de cualquier perjuicio que pudiere producirse por la vulneración por parte de la Persona Usuaria de su obligación de mantenimiento actualizado de sus datos de contacto.

11. LEY APLICABLE Y JURISDICCIÓN.

Las presentes CGU se regirán por lo dispuesto en la legislación española.

Cualquier controversia relativa a las condiciones de uso y acceso a este Web contenidas en el presente documento de CGU de la Web, las partes se someterán, renunciando expresamente a cualquier otro fuero que pudiera corresponderles, salvo que por imperativo legal se determine lo contrario, a los Juzgados que corresponda.

III.- BASE LEGAL QUE LEGITIMA EL TRATAMIENTO DE LOS DATOS PERSONALES
En cada tratamiento específico de datos personales le informaremos de la base legal que lo legitima.

IV.- DERECHOS
DERECHO DE ACCESO
Es el derecho a obtener del responsable del tratamiento confirmación de si están tratando o no datos
personales que conciernen al interesado y, en tal caso, derecho de acceso a los datos personales y a la
siguiente información: los fines del tratamiento, las categorías de datos personales de que se trate, los
destinatarios o las categorías de destinatarios a los que se comunicaron o serán comunicados los datos
personales, plazo de conservación o los criterios utilizados para determinar este plazo, la existencia del
derecho a solicitar del responsable la rectificación o supresión de datos personales o la limitación de

DERECHO DE RECTIFICACIÓN
Es el derecho a solicitar la rectificación de sus datos personales si son inexactos, incluyendo el derecho a
